How foreigners can own Puerto Vallarta Real Estate
Restricted zone regulations used to prohibited foreigners from buying Puerto Vallarta real estate. The law states that foreigners cannot own real estate within sixty miles of an international border, or within thirty miles of the Mexican coast. However, the Mexican government realized the need to accommodate those who wanted to make real estate investments in Mexico.
The solution is known as a Mexican Property trust, or ‘Fideicomiso’. This safe, simple and fully renewable Mexican property trust enables average consumers who wish to vacation or retire in Mexico own Puerto Vallarta real estate property. As an estate trust, the Fidecomiso gives you, all rights of ownership.
How does the Fidecomiso work?
A permit is issued to a Mexican bank by the Mexican Department of Foreign Affairs. The selected bank becomes the trustee, thus making you the beneficiary of the trust. Ownership of the property still belongs to you, the bank acts as the trustee as in the case of a living will or estate trust.
As the beneficiary and owner of the Puerto Vallarta real estate property, you have the usual rights of ownership, which means that you can:
- Use and occupy the property
- Build on the property
- Improve the property
- Sell the property (through instruction to the trustee)
- Bequeath the property in a will
This trust term is usually fifty years, and it is then renewable every fifty years. The simplicity and convenience of a Fideicomiso means that it is now easy for you to enjoy the many benefits of owning Puerto Vallarta real estate.
